You need to contact an attorney that practices personal injury and wrongful death. The first step would be to open an estate in probate court. MI law has specific procedural steps that must be followed in order to bring a wrongful death claim. I would advise you to contact an attorney as soon as possible.

I recommend you speak with a new bankruptcy attorney about your options, and whether the Trustee has the ability to go after your settlement money so many years after discharge. Good luck.

  • I'm a nurse who had an accident from driving drunk. I went to a party on New Year's Eve and people were smoking marijuana.

As a probationary per trail exam I was ordered to take a drug test in which was positive for thc. Will the court system or probation dept. report the positive drug test to the state board of nursing? I personally do not smoke marijuana.

    William’s Answer

You should speak with a criminal defense attorney in Detroit area immediately to find out what the possibilities are. It is possible you may have a duty to self report to the state board.

My colleagues are, correct most auto insurance providers have specific exclusions for accidents involving stolen or unauthorized use of a vehicle. If you have the same insurance company contact your agent and bring them up to speed on the situation. If you have switched companies you need to get ahold of your old policy and discuss the issue with your former auto insurance provider. Good luck.

  • Can I marry the man I have LAWSUIT AGAINST his insurance company? It is a pain and suffering lawsuit, No pip insurance

2 broken ankles, head trauma, 4 stiches , left leg and knee injuries etc.

    William’s Answer

It generally does not look good for a plaintiff to marry the defendant in the middle of a lawsuit. Think about if you were on a jury and these same facts arouse. It would probably seem very suspect and a jury would be less likely to believe this accident was truly an accident. Also, if you have car insurance you would have PIP coverage. Speak with your attorney, and if you don't have one I would recommend you contact one .

  • If someone loses control of their car and runs into my landscaping boulder, am I liable for damage to their vehicle?

    William’s Answer

The boulder sounds like it is more potential trouble than it is worthy. If someone was seriously injured due to the boulder you could face potential liability.

    William’s Answer

From the facts you have described your fathers auto insurance must cover all of your fathers medical bills related to the accident under Michigan's No Fault law. I would recommend you contact a auto accident attorney and get all of your questions answered and see if your father needs to bring what is called a first party suit against his auto insurer. Under Michigan No Fault every insured driver has personal injury protection called PIP. The PIP benefit covers all medical bills related to an auto accident for life and their is no cap on the benefit. Feel free to contact my office for a free consultation (616) 965-1088.

    William’s Answer

I am very sorry to about your son. My name is Bill Failey and I am a personal injury attorney based in Grand Rapids, MI. You do have legal options and I would be happy to sit down with you for a free consultation and go over those options with you and evaluate your sons case. In the mean time I would contact the police and file a report. If this is a situation where your son is being bullied regularly by the same young man a restraining order may be a starting point as well.
