Description:We defended a client in the Genesee County Circuit Court in Flint, MI who was charged with two felony counts of criminal sexual conduct, third degree [penetration with force or coercion]. We were prepared to go to trial and had some good defenses. Our chances for an acquittal were good, but the victim had testified at exam in detail what our client allegedly did to her. She provided a series of detailed [but inconsistent] statements to the police. Although we like our case, an acquittal could not be guaranteed; never can. So we bargained from a position of strength with the assistant prosecutor and on the day of trial, just prior to selecting a jury, the prosecutor finally relented, acquiescing to our demand for a reduction to a circuit court misdemeanor and no jail time. Client was very happy and relieved.
