  • I live in Michigan and I have a warrant out for a violation probation for a OWI offense, will I be able to travel domestically?

    If you have a warrant for an OWI it is likely a bench warrant. Meaning that the police may take you in if they pull you over and you are with in the "pick up" range. Some jurisdictions will not go far. For instance, in my experience Detroit will not go out to West Bloomfield which is relatively close.

    When you say domestically do you mean across the country? Highly unlikely Michigan would want you from Florida.

    Regardless, you never know when you are going to get stopped and being held can be a major inconvenience.

    You can easily get one by requesting it from the Lansing office. However, if you are going to appeal I would suggest filing the petition, you only have 63 days from the date of the order.

    If you want the no contact order lifted you will need to contact the prosecutor or victim advocate. You may need to appear in court to have the change made.

    Usually the prosecutor will send you a subpoena when they need you there. No reason why they would need you at arraignment or pretrial unless specified.

  • I've already been convicted of felony OWIL w/ injury. The injured was my wife and has fully recovered with no ill effects.

    Is it possible in the future to have the felony reduced to a non felony crime? I feel like my life is over as a felon and may as well have perished in my accident, I'm very troubled over what I did.

    It is unlikely. Not to say it cannot happen, but as of now there is no legal mechanism to accomplish what you are looking for.

    You could possibly file a motion and if you get the right judge and prosecutor it may be possible.

    I agree with the previous lawyer, they may still find it. You are between a rock and a hard place. Have you pulled your criminal record? Have you pulled your CA driving record and criminal record from their state police?

    Likely that they will deny you if they find it later and you weren't truthful.

    By taking guilty plea, jail has been taken off the table. How long should I expect to be on probation and what can I expect with Southfield probation? Will I have to do random screens?

    I agree with the previous lawyer. 12 - 18 months probation depending on the BAC, MADD impact panel, community service, possibly an alcohol education course, random PBT's. Fines, costs, license suspension / restriction. 6 points on your license.

    Maybe consider hiring someone to see if they can sweeten the pot.

    He should not be talking to anyone but his lawyer. He should be arraigned and a bond applied. Having a lawyer at that hearing could help a lot.

    Bring a lawyer with your to the hearing. You have no idea what she may claim and you need to be on the ready.

    My guess is that you would have to search in New York. Here in Michigan we have iCHAT that allows you to look up someone record for $10. Juvenile stuff often will not show. NY may have a different system. You could always ask him what court it happened at and call that court or request the info under FOIA. If nothing comes up then it either wasn't at that court or it was sealed.
