A civil suit was filed, discovery was conducted and preparations were made to proceed to trial. After discovery closed, the defendant contractor chose to settle the case rather than go to trial. The settlement amount exceeded the amount of money Mr. Secontine's client originally paid the defendant.

Mr. Secontine surrounded the client with medical expertise and professional investigators. The data gathered on behalf of the Client resulted in the criminal investigation going nowhere and the Client's name being withdrawn from the CPS Central Registry.     Client was employed in the scrap metal business when some scrap metal was delivered to his employer. Client followed the law and processed the transaction, generated the necessary documentation and preserved the requisite records. When it was learned later the scrap metal was believed to be stolen, Client took swift action and notified BOTH law enforcement and the presumed property owner. Additionally, the pertinent documents from the transaction were tendered to law enforcement and multiple arrests were made and convictions were secured. Surprisingly, Mr. Secontine's Client was also charged despite his lawful actions and his commendable response on behalf of law enforcement. Rather than accept a "reduced plea", Mr. Secontine held the Government to their proofs in court. The case was DISMISSED on Mr. Secontine's motion in Circuit Court. A subsequent appeal filed in the Michigan Court of Appeals by the Government was later withdrawn for lack of merit. The DISMISSAL STANDS.
