    These are completely different charges. Reckless driving is a non alcoholic related offense which would make it a great plea reduction. The only issue is that it involves a 3 month hard suspension. Usually if the prosecutor is willing (which many many times they are not), I try to get it reduced to a careless driving (civil infraction).

    You should absolutely plea not guilty at arraignment. 99% of the time this is what happens. Often magistrates or judges wont even let you plea not guilty at this stage.     Based on michigan law, I too believe you may have a defense. You need to fill out the paperwork on the back of your refusal ticket and send it in so that you can have a hearing.     Based on your description it is too early to tell if a reduction below a OWVI is possible. Usually these reductions are relatively rare, but they do and can happen. You however are not allowed to plea to an OWI under advisement. You absolutely need to contact an attorney as soon as possible.     I am little confused over the question. Are you saying that you got an additional OWI on top of the impaired driving charge you already received? If so, much depends on whether or not your OWI was found out when you gave your interview to probation. If it was, then it is likely that the judge will know and take that into consideration for your sentencing. If not addressed in sentencing, it could be addressed later on. Much also depends on whether or not you had a Cobbs agreement in place....

    If the incident happened in detroit, it is probably just a mistake. The clerk at the court probably didn't update the Michigan State police information correctly. I wouldn't look into it any further and be happy with your luck.

    It is very very unlikely that you will not receive probation on an OWI, even as a first offense. Practically the only time I ever see this is if the person is also convicted of something else and will be incarcerated for a significant amount of time on other charges or when the person is deported immediately upon conclusion of the case.
