I also agree that you need to report her passing to the insurance company, and I also advise that you make a claim for the life insurance proceeds as your fiance's beneficiary of the policy. Whether the policy was still in force on July 6th will depend on whether coverage was extended throughout that 30 day period during which she had the option of converting her group policy to an individual policy. The life insurance policy itself will determine whether the nature of her death affects the...

When you receive LTD through your employer's policy, you are generally required to also apply for SSDI through a provision on your LTD policy. If you're then approved for SSDI, your LTD benefit will be offset by the amount of your Social Security benefit. Advantage 2000 is hired by Cigna to pursue SSDI on your behalf because Cigna benefits by the reduced LTD benefit if you are approved by SS. In your case, you haven't been approved for SSDI yet, but it sounds like Cigna is trying to...

I agree with my colleagues that you should at the very least consult with a lawyer prior to filing an appeal, if not obtain representation from an attorney specializing in employee benefits. Please be aware that you must file your appeal prior to the 180 day deadline or reach an agreement in writing for an extension of time, if the insurance company will provide one. It is imperative that you not miss this deadline to appeal your claim for disability benefits. An attorney who specializes in...

It depends on the source of your disability income (long term disability plan, Social Security Administration, disability retirement plan, etc) and the terms of the plan that provides those benefits. Some long term disability plans will offset your monthly disability benefit by certain amounts received from retirement income. Assuming your disability benefits are received via an employee welfare plan, you will want to obtain a copy of the plan and determine what the deductible sources of...

You mother's policy likely requires her to repay the overpayment, but she should request a copy and review the policy to be sure. Additionally, she will want to make sure she understands the basis of the overpayment and the LTD insurer's calculations. It is possible that the LTD insurer may work with her on providing additional time to pay the overpayment in full. Otherwise, it is likely that the LTD insurer will deduct a certain amount from her monthly LTD benefit in order to satisfy the...

You should check both your disability plan (if you are receiving short or long term disability benefits through your employer's plan) and your medical insurance plan to determine whether your medical insurance will continue so long as you remain disabled. Your benefits representative or HR should be able to provide you with a copy of both your health plan and disability plan. You may also ask your HR or benefits representative to assist you with the documentation the health insurer needs in...

  7. My question is: Can I collect disability AND unemployment benefits (Non SSI) at the same time?

    Answered over 1 year ago.

    1 lawyer answer

Generally speaking, in order to continue to collect unemployment benefits, you must certify that you are able and willing to accept full time employment, should it be offered to you. If you are on temporary disability and unable to certify that you could accept full time employment, you would not remain eligible for unemployment benefits. Similarly, in order to continue to collect disability benefits, the disability policy usually requires you to be totally disabled, or unable to work in any...

You should ask GM to send you a letter outlining the reasons they are denying your claim for benefits. Also, you should send GM a letter addressed to the pension plan administrator asking for a complete copy of the pension plan and any other documents related to your father's pension benefits and your claim. With many pension plans, there are certain steps that must be completed in order to effectively change the designated beneficiary. Hopefully your father completed whatever steps his GM...

I agree with Mr. Cheban about speaking with your employer regarding use of your vacation time. In the meantime, you might also consider appealing the denial of your short term disability benefits. In some cases, short term disability plans require that you use unused vacation time before you are eligible for short term disability benefits; some plans do not have this requirement. In either case, it may be worth filing an appeal.

There are two primary kinds of disability benefits: 1) Social Security Disability, and 2) short and/or long term disability offered through your employment or purchased privately by you. You should check with your Human Resources Department to find out whether you have short and/or long term disability and what the requirements are for meeting the terms of the plan. You may apply for both Social Security disability and short/long term disability (if available) if you become disabled. In order...
