In Indiana, if your employer has a formal or informal policy of granting vacation, based on length of service, the vacation is deemed deferred compensation, in lieu of wages. If you have earned vacation based on such a policy, it is unlikely that your employer can let you take time off, but not pay you for it. Make certain you have a copy of any written policy established by the employer. Contact the Indiana Department of Labor for starters.
