Description: I represented the manufacturer of a snow thrower. The plaintiff injured himself on the impeller of a two-stage snow thrower. Upon inspection, it was determined that the retailer improperly set up and serviced the snow thrower. The manufacturer filed a motion for summary judgment based on the retailer's actions. The court determined that the retailer's actions resulted in a supervening, superceding action and that such actions were the cause of the plaintiff's injuries. The retailer's supervening, superceding actions resulted in my client being found not liable for any injuries to the plaintiff.
