  • Is it against the law to date a 14 year old if im 18 but both parents are ok with it

    ????/?/

    David’s Answer

Generally, no. The age of consent for someone is 16. Regardless of the parental consent, if the police or prosecutor get the information, they may press charges. Also, the parents might consent now, however, if you break their little girls heart, your going to have problems. Also, I am assuming that you are only dating and not having sex. I am sure you did not get permission from the parents to have sexual relations with her, and if you did, her parents are sick and you should get away from this family as soon as possible. Leave little girls to little boys. You do not want to have to start registering with the sheriff's department as a sex offender.

    David’s Answer

The price for an attorney can vary depending on a lot of different factors. Generally, I charge between $750 and $2000, depending on what is needed to obtain the best results. Sometimes a motion to suppress, or a trial is needed. If a person wants to work out a plea, or lower charge, then generally, the cost will be the lower end. • Terminating parental rights on an absent parent

i got pregnant by a guy i had worked with, who was only temporarily living in Ohio. He moved back out of state when during my pregnancy. No one signed the birth certificate as a father. My son will be turning one in a few days, and since his birth...

    David’s Answer

You may be incorrect about the biological father having rights. The biological father has to secure his rights by signing the birth certificate, signing a paternity affidavit, registering with the putative father registry, or have a court order for visitation or to pay support. In otherwords, he may be the biological father, but if he is not the legal father (having rights) because he failed to do any of the above. You may have your fiance adopt the child without the biological father's consent if, none of the above things have been done. Also, if any of the above things have been done, the child may be adopted without the biological father's consent if he has not paid support for 1 year or has had none, or very little contact with the child for at least 1 year.

  • I had a yard sale and sold some items. The guy wanted me to hold them, but he hasn't picked the items up in 3 weeks! What now?

He asked us to hold them for the weekend, then he said he would take a little every weekend until it was gone. Then he said he would get them the following Monday, then, when I called him - he said he wants us to deliver it to him for $20, however...

    David’s Answer

My suggestion is to notify him that he has breached your agreement, which he was supposed to pick up the stuff each week until it was gone. Give him a deadline (in writing) that if he does not pick up the items then you will deem them abandoned and after that you will discard them. You should be ok.

  • How can i get all rights of my kids?

My kids fathers are drug addicts, refuse to pay child support thats court ordered, never sees them or calls them! My kids cry for their dad occasionally and when you go to their residents they hide, i am tired of them jumpin in and out of my kids...

    David’s Answer

Generally, you cannot terminate a father's rights unless someone adopts the child. You can apply to the court to suspend visitation because of the drug issues and provide drug testing to prove that they are sober before visitation can occur again. The fact that they do not pay child support does have some weight in the process, but not a lot. Child support and visitation are kept separate except in extreme circumstances. Just because the father does not pay support, does not mean that he loses visitation. Sorry, if this was not the answer you were looking for. Unfortuately, if the children need therapy to get through this situation, get them the help they need.

  • Are you aloud to sell a car with a salvage title for blue book value?

car lot sold car above blue book value with a salvage title.

    David’s Answer

Yes...but you must inform the buyer that it is a salvage title. The most important thing is to check out every car that you are going to buy. Have a mechanic look it over and get a warranty if you can. Caveat Emptor means let the buyer beware. It is usually on the buyer to look for items that would lower the cost of the car, do your homework and good luck.

    David’s Answer

I agree with Mr. Kaltenbac. As an attorney in Cleveland I have run into this quite often. The landlord must be provided with a written forwarding address. The landlord then has 45 days to provide you with the money or an itemized list of damages. Make sure that part of the landlords eviction was for damages. The courts will schedule a second hearing to award damages. Did you miss this hearing or did he not ask for damages. Contact my office for more detailed answer.

    David’s Answer

I have dealt with this issue on many occassion. She cannot be charged with kidnapping. I agree with the previous attorney, you should contact an attorney immediately. The attorney will be able to get the paperwork from Michigan and find out what the issues are. She may not have a order of protection on you and is just trying to keep you away. Call me with further questions. I am in Lakewood, OH.
