Description:The Defendant was charged with two counts of Aggravated Robbery and two counts of Felonious Assault for allegedly robbing two banks at gunpoint. All counts included one and three year gun specifications. Both robberies were consolidated and the trial lasted approximately two weeks. The jury was confronted with eyewitness testimony from the teller who positively identified the Defendant in open court as the individual that had committed the crimes. Through cross-examination and usage of a demonstration showing the unreliability of eyewitness identification, the jury acquitted the Defendant of one count of aggravated robbery, two counts of felonious assault, and all gun specifications. The jury hung on the remaining count of aggravated robbery. Prior to the re-trial of the remaining count, the State dismissed the case.
