  • I hired a lawyer 4 months ago to get custody of my granddaughter and she has never got this into court. How long should it take.

    Anna’s Answer

You should contact the attorney that you hired and talk to her. If she has done absolutely nothing you can ask for your money back minus the fees that she has earned. In Kentucky, generally grandparents do not have legal standing to ask for child custody, unless the child has been in their exclusive care for a specified period of time and they have become what is called "de facto custodians." Grandparents in KY have reasonable visitation rights if it is determined to be in the best interest of the children. If you are a grandparent and believe that the child is abused or neglected by his or her biological parents, you can get the CPS involved. If the child is removed, you can then ask that the child go to you upon removal but that's all you can do. Ultimately it is up to the judge where the child will end up. Because you don't have any legal standing to ask for custody, It is best to do this by an agreement with the biological parents if possible.

You will likely qualify for a diversion. You may have to do some volunteer work. Ultimately there are options available for first time offenders to keep this off of your record. Call a lawyer to discuss your case(s) in person. In the past, I have been able to have these types of case dismissed with some community service. Best!

  • Do I have to use the same attorney for expungement?

I had a citation dismissed about a month ago and as I finish up my court issued service hours to get it expunged, my question is do I have to use the same attorney? They are wanting $300 to do it and as a budget minded person that seems very steep.

    Anna’s Answer

You can use another attorney. The background check fee is $40.00 plus a lawyer's fee. I usually charge less for expungements. You can also attempt to do it yourself without attorney however it's just easier to let a lawyer handle it, that way you don't have to worry about it.

    Anna’s Answer

If you didn't receive notice of the Court date you may potentially have a way in to re-open the case. It depends on how long it has been since the Court issued the order. Normally to modify custody it must be 2 years since the last modification. Speak with a family lawyer to determine the best possible course of action for you.

    Anna’s Answer

Biological parents have rights, however if the child has been in your care for a certain amount of time with no contact from the biological dad, you may be a de facto custodian and have legal standing in Court to ask for custody. I would contact an attorney. You can wait until he files, or you can file a petition for custody yourself before he files.
