    There is a such thing as a defective affidavit, which is what you have here. If you would have hired an attorney then you would likely had your ticket dismissed for failure of the cop to show up (for no one to testify against you) but that is over and done now. If you are serious about beating the ticket, then hire an attorney to help you, that is what we are here for. Otherwise, just pay the fine and move on.

    She is in serious trouble as you can understand because the cops hear this excuse all the time. She needs to contact a criminal defense attorney who can get a copy of her prescriptions, a copy of her pharmacy records, and maybe even her regular Dr to come and testify on her behalf as to how she is sometimes confused when the seizures happen. Generally, most cops are not trained to deal with people who have true medical conditions and they think they are faking it. The fact that she does not drink will be a good point for her case, and having friends to testify to that will be good too. Often the jail nurse is over whelmed with request for meds, so that is not unusual even if it is not fair. There are a lot of good criminal defense attorneys in Oxford, and you should help her find one. Don't just hire the cheapest, but hire the one with experience and one that you feel confident with. I recommend checking into one of the attorneys that have previously posted an answer to your question on this post, as they have already given you a sign that they are interested in helping your daughter.     You definitely should ask for a refund for the nights stay. I don't think you have enough damages to bring a lawsuit, but you may want to use Justice Court for such small claims, but since you will need to do so in Gulf Shores and you live in Corinth, I don't think that is much of a good option either due to the fact that it is so far to drive.     There is not set time, and the DA will indict them when they finish their investigation. There is no statute of limitations on Murder. The DA's office will stay in contact with the victims family.

    You should try to have the possession expunged from your records. Possession with intent or manufacturing can not be expunged under current MS law but regular possession can. Best of Luck!
