  • Should i have to pay for new eye glasses?

my eye care provider sent me home with the wrong Rx in one of my lenses. They will replace my glasses with the old Rx, but during the 8 months of wearing my glasses with the wrong lens, my eye Rx has changed and they are only offering me a 50% di...

    Russell’s Answer

If you were to sue them you would have to prove their negligence and that the Rx changed due to their error through expert testimony. Typically, experts do not testify for free. Would it be economically feasible for you to pursue a claim over having to pay for 50% of the new Rx? I would think not.

    Russell’s Answer

I am sorry for your loss. The family needs to consult with a nursing home abuse and neglect attorney regarding the care your brother received. The ultimate goal is to hold the nurshig home accountable for any wrongdoing not only to compensate for the loss of your brother but also to prevent this from happening to someone else in the future.

    Russell’s Answer

I am very sorry for your loss.

If the nurses failed to comply with the standard of care and your brother suffered an injury as a result thereof, there is certainly a case.

At this stage you need to get a copy of the nursing home chart and have a nursing home attorney review it.
