    Russell’s Answer

You can absolutely fire your lawyer - although he might assert a lien against your case if you fire him.

You are not obligated to settle your claim. You can file suit and take the case to trial if the insurance company does not make a fair offer.

    Russell’s Answer

I think you need to wait and see how your son is affected by this incident before you make any decisions about whether to pursue a civil claim for pain and suffering. And, in my mind, whether you choose to pursue criminal prosecution should not be determined by whether they compensate your son for his pain.

    Russell’s Answer

You can always represent yourself and you will not have to pay an attorney fee. There are books you can buy that outline the process of handling a claim. And there is a law library where you an go research the applicable law.

Or you can hire an attorney and have him/her handle it. That is not free, nor should it be.

    Good luck and best wishes.
