Description:In Tennessee, multiple convictions for simple possession of drugs can lead to a felony charge, if arrested again. My client was pulled over for a minor traffic infraction and the police subsequently asked to search the car. After finding small amounts of a controlled substance, the officers arrested my client, took her downtown, and charged her with felony drug possession. My client was acquitted due to two reasons. First, the procedures the officers used to gain entry into the car were not supported by the law. Secondly, the quantity of the alleged contraband reported by the officers was not the quantity that the officers actually found on my client. Take away: There are two sides to every story. There are also procedures that must be followed.
