  • I got busted March 15, 2013 for underage drinking and violation of curfew. Will I loose my DL?

I spent the night at a friends house and we were drinking and we went walking at 1:30a.m. We got stopped by Greenbrier PD. The officers never read us our Miranda Rights. Whenever you get arrested the Police Officers have to read you your rights co...

    Blake’s Answer

Police do not always have to read you your Miranda rights. They don't have to do it but if they don't read you your rights then anything you say can't be used against you. This does not eliminate the use of testimony about your actions or what the officer sees or hears. The officer could still say he smelled alcohol on your breath and you were swaying as you walked. You should definitely consider hiring a defense attorney in your area to consider your BAC and your age in what you can actually be charged (crimes). Such as are you under 18 or under 21. There are facts that effect the possibility of dismissal and expungement. Contact me at 615.305.4539.

  • How far back can the post office do a background check?

Post office background checks limits in Illinois

    Blake’s Answer

If you are applying for a job with the U.S.P.S there is not a time limit as to how far they can go back, except that they will probably not look at any juvenile delinquency records or matters. However anything since you turned 18 and which has not been sealed or expunged is going to be on your adult record.

    Blake’s Answer

Seek an attorney. Preferably an attorney that is knowledgeable about US Code Section 1986 (not the year but code #). The Police department report, location, and call logs for the officers on duty at that time will give you some idea and proof as to what they were doing, when and where. Be able to answer and save proof of all damages: broken items, lost wages, psychological counseling, money lost, etc... due to the police actions against you.

  • Will I get jail time for a FTA larceny 6th?

I failed to go to court at the time my daughters father died and it was a hard time for me now I have a warrant just want to get it fixed but I'm wondering if I will face jail time

    Blake’s Answer

Jail is possible with a criminal conviction; however, it not likely. You need to retain an attorney to evaluate the situation and consider the Court's history in similar situations and hopefully avoid a conviction.
