    If you are the biological parent of a child and you are not the primary custodial parent, yes you have to pay child support. You can sign your rights away if there is another person willing to adopt the child and take your rights as the non-custodial parent. Understand, the child can not go from having two parents to having one. The child has a right to have two parents.     Yes. Tennessee law has no ban on having a passenger in your car. You must comply with the restrictions on your driver's license. If you have an interlock device requirement, you must drive an vehicle with the interlock or only going to and from work. It is possible that a Judge could order additional restrictions beyond what the law requires.

    Implied Consent violation is a one year suspension of your TN driver's license (refusing to give a breath or blodd). Implied Consent is not negotiable. Reckless Driving could have up to 11 months and 29 days in jail or probation for the same period or as little as no jail time and probation lasting only as long as it takes for you to pay all of the fines, fees and Court costs. Its all negotiable, including the fine.

    Police do not always have to read you your Miranda rights. They don't have to do it but if they don't read you your rights then anything you say can't be used against you. This does not eliminate the use of testimony about your actions or what the officer sees or hears. The officer could still say he smelled alcohol on your breath and you were swaying as you walked.
