    Be very careful listening to the adjuster. They do not have your best interest in mind. If they settle with you only for the difference, you will still be obligated to reimburse your health insurance company for the amounts they paid, and you will end up going backwards. Consult a local attorney that knows how to handle personal injury cases.

    Make sure the medication mistake was the doctor's, and not the pharmacist. While this would not be practical to pursue against the doctor, if the pharmacist made the mistake you would have an easier time making the economics work.

    I agree that summary judgment is difficult to survive in a case that hinges entirely on documents.     Your question is dependent on many factors. Generally, a verbal contract is binding in Alabama and that claim would be good for 6 years from the date of the breach. You seem to be talking about a verbal agreement to break a written contract, however, which is an entirely different situation. That will be dependent on the specifics of the written contract. Generally, though, it will depend on whether you have relied on the verbal statements to your detriment. Take your lease and all evidence to a local attorney for specific advice.

    It should not have any effect on your coverage. By definition that coverage can only be used if you were not at fault. That is what it is there for.
