    I agree. It is not illegal in and of itself. I have seen it used as additional evidence in getting a civil restraining order but I dont think it would normally be enough on its own.

    It is very difficult to withdrawal your negotiated plea. You must prove that the plea was the product of coercion, misrepresentation, fraud or duress, or that you were legally incompetent to enter into the plea. You must file your motion within 30 days of the sentence being rendered, and if you lose it, you can appeal that. You must be careful what you wish for. If you win, your case will be put on the trial docket and it is unlikely you will get any more plea offers in the future. Not...

    Yes, it is possible. A judge can only find you guilty of VOP if your acts or failure to act was both a willful and substantial violation of your probation order. In this case, failure to get the class done on time is probably going to be considered substantial. You may have an issue with the willful requirement.     Listen to your lawyer. If you don't want a dui on your record, you may need to go to trial. If they offer you something you are willing to live with, then you may be able to avoid a trial.

    No, the officer may request a breath sample and if you dont provide it, they will deem it a refusal. If you have a prior refusal that can be charged as a misdemeanor. You have 10 days from the arrest date to challenge the administrative suspension with the dmv. If you were unable to give the sample due to a medical reason, that could be a defense.     Yes. Martin County Core Probation is very good about allowing probationers to mail in their requirements. Talk to the probation officer.
