Contact a local Family law attorney to Answer the Petition. I suggest that you also consider finding a therapist for your daughter, as the therapist can help the Court decide what is in the best interests of your daughter.

You can file a small claims action against your neighbor for the damages. You can obtain the forms from the Lee County Clerk. Complete the Complaint, obtain a summons, and have your neighbor served. The Clerk will provide you with a date for your mediation. Be sure to have copies of the bills. If the case does not settle, you will go to a trial, and a judge will hear your case. Ask that the Judge also award you the cost if filing your case, in addition to your $323 in out of pocket damages.

As Mr. Lopez stated, you would have a case for trespass if you had proof. Without proof, you would most likely not be successful in pursuing this matter.

    Michele’s Answer

It means that the Clerk of Court mailed something to either you or your soon to be ex spouse, and it was returned to the clerk by the post office as non-deliverable mail. It could be a notice of a hearing, or an Order of the Court, so you should contact the Clerk and find out. If you moved, file a notice of change of address with the Court.

    Michele’s Answer

You have not provided enough information for a lawyer to give you an opinion. What false allegations are you referring to? If he has violated a Court Order, a Contempt and a Motion for Emergency Hearing would be appropriate.
