    The safety of the children is the most important issue before the court. A convicted sex offender could definitely be considered a danger to the children. Don't even try to tell the court that he was innocent because they have heard that from everyone that was ever convicted.

    Of course you need to prove it. You can prove it by calling him to the stand and asking him to show that he lived up to the order. The order is in the court file and can be judicially noticed.

    Annulments are extremely rare. It requires a void marriage. Divorce is what you will be seeking. There is no way to answer the question of what you can recover based upon the facts provided, but it may be that you will not be able to recover the losses that you cite.

    This charge can lead to prison time under the guidelines depending upon how victim injury is scored. This is in spite of you being a first offender. You are entitled to a public defender but you may want to hire a private attorney. It sounds like you have a good defense and the incident is probably on surveillance tape. You should hire someone who can subpoena the tape. It may be instrumental in aiding your defense
