Outcome: Not Guilty Verdict to Agg Battery Deadly Weapon
Description: Client was an Iraqi war veteran having served in the USAF for 8 years. He was charged with Aggravated Battery with a deadly weapon (car) after hitting a pedestrian in the street. His friend had just had an argument with the same person who walked out in front of client's car and was struck and injured. Because of the previous argument, the state's theory was that client was retaliating against the victim and ran him over with his car. The defense presented a forensic engineer who did accelleration testing on client's car to discredit the state witness testimony that his car was traveling 35-40 mph at the time of the accident. Client testified as well. Acquittal in less than an hour.
