    You always have the option to seek justice in a court of law. Prior to filing the small claims complaint, consider sending a demand letter, simply proving a summary of what the agreement was, give a deadline to make payment (or payment arrangements) stating a definite date, time and location payment is to be made. End the letter with a general statement that you will seek legal remedies if deadline is missed.

    As it stands, your husband is the owner and seller of the home. You are not legally tied to the home, nor does your credit play a role in this transaction because you are not applying for a loan.     A deficiency is the loan amount less what the home sells for. A lender will have an option to pursue that amount difference and gain a deficiency judgment against you. To avoid this, contact the lender to what viable options you may have to either save your home or sell it with less debt owed on it.
