    Sagi’s Answer

I would first try talking to your attorney and find out his or her thoughts regarding your case. Specifically, you need to know what are the hurdles you face in proving liability, why is the attorney demanding what he/she is demanding. You need to understand the lawyer's thought process. Of course, if you are not satisfied after meeting with your lawyer, you can always switch attorneys.

  • Is a personal injury settlement/award from an asbestos related injury taxable?

I am suing a company for cancer that I got from asbestos while I was a plumber. If I get any money by either settling or after a trial/jury verdict do I have to pay taxes on the money?

    Sagi’s Answer

You need to speak with a financial advisor to be safe. In general money for pain and suffering damages (non-economic damages) are not taxable. Money you receive for lost wages and/or loss of earning capacity from personal injury case is a taxable event.

    Sagi’s Answer

In general you can amend a motion but would have to provide opposing counsel with the proper time to respond if they wish. So you would have to reset hearing date.

Sounds like workers comp claim. It would not be covered under a regular third party personal injury claim against dealership because insurance companies don't cover intentional acts.
