HOA and personal liability with illegal steps

Typically the HOA documents or deed restrictions would state that the Home Owner would not be allowed to change any permanent condition that was originally maintained by the HOA. In this case (if I understand you correctly), a neighboring HOA member has violated a permanent structure within your HOA and your HOA has not responded to the removal of the fence. I believe your HOA would have a duty to notify the home owner within your community that he is in violation of the HOA covenants, and,...
