    If you receive a monetary gift you will not have to pay any taxes as the recipient. The donor can benefit from your gift because of (1) reduced estate taxes and (2) reduced income taxes. Moving money out of an estate via lifetime gifts removes future appreciation on the asset. Plus, if you give property that has a low tax basis (such as a rental house that has depreciated way below its fair market value), or property that generates a lot of taxable income, you may reduce income taxes paid within a family by shifting these assets to family members in lower tax brackets.

    The common law rules in Texas will help you to determine if you can qualify as married. The head of household status should not be overlooked. If the primary concern is immigration then you should do what is best for immigration if filing either way has the same tax consequences.

    Unfortunately, the tax rules state that early withdrawals from a 401(k) plan are taxed as income. Plus, there is a penalty.

    There are other ways to deal with your tax debt. Including negotiating the amount with the IRS. You need a tax attorney to get this resolved immediately.     Please do not let your home go up for sale. You must contact a tax attorney to handle your case immediately. The equity in your home can be used to fix the situation. But, be careful. There are many unscrupulous people that may take advantage of you when you are trying to get a loan. An attorney will help protect you and your finances. You can also work on getting the County to delay the auction. Even though you are unemployed, have no money or credit you can get help.
