Adjustment of Status/ Cuban Adjustment

Description: Client is a native and citizen of Cuba who was paroled into the United States in 1962 when he was 16 years old as part of "Operation Peter Pan" Client later filed an application for Relief from Training and Service in the Armed Forces when he was 21 years old and during the Vietnam War. Because of his request to be exempt from military service he was subsequently denied all Adjustment of Status applications (including appeals) under the Cuban Adjustment Act and was labeled as a "military draft evader". I was able to successfully argue a little known and used Presidential Pardon that was made available in the 70's by then President Jimmy Carter. My client finally became a Legal Permanent resident after being in the USA for 50 years!
