  • Internet law: The right to disappear act. New internet law in the EU.

So the European Union (EU) just passed the right to disappear act, so people living in the EU can request their name be blocked from the internet, specifically Google. Is America in the process of implementing a similar law? I hope so. The interne...

    Marc’s Answer

There is so much misinformation about this issue. First off, the EU did not pass any such act. In the EU, you have a fundamental right to privacy. That was interpreted to require search engines to de-list reports about EU citizens, if they were deemed to be "irrelevant" or "outdated."

The sheet he was looking at was a DIFFERENT patient NOT me. Verified by my primary Dr. This Dr I was seeing for the first time. I went in for a stress migraine. I was a nursing student with 5 exams coming up. I asked for Tordal and Zofran. Shots ...

Defamation requires a false statement of fact about another person, published to a third person. It does not sound like, in these facts, that there was anyone else who heard his statements. There are other problems with a case here too, but that's the threshold question -- did he publish the statements to a third party? If not, no defamation.

  • I quit my job a few weeks ago because my boss (even after a meeting with human resources) continued to slander my character.

    Marc’s Answer

You should talk to an Alabama lawyer who can help you with your unemployment appeal - that's your best bet. I can't see any facts that seem to lend themselves to this being a libel question.

  • I think I may have a libel/slander/defamation issue with a neighbor in my HOA. The Board won't help with this at all.

This resident in my HOA (she is a renter and not even a member of the association) has sent a letter to all homeowners when I was a candidate for the Board filled with assumptions, insinuations, and very little truth. Then, the day after the elec...

    Marc’s Answer

If someone is making false statements of fact about you and publishing them, you may have a defamation claim. However, depending on the context, they may be privileged or otherwise immune from liability. Really need more information to analyze this. However, prior to engaging in any defamation claim in Nevada, ask your attorney if they are familiar with the Nevada Anti-SLAPP statute. If they are not, tell them to get up to speed on it before they do anything.
