You can certainly not obligated to stay in the martial home, but there are several factors you should consider before making your decision, most importantly the children, if any. If you move and leave the children in the marital home you are going to want to establish a temporary time sharing plan as quickly as possible.   • I was told that I will receive my judgement for divorce within 30 days and the final divorce papers in 90 days from MA court.

    Can I get remarried once I get my judgement for divorce after 30 days or do I have to wait for the final divorce papers in 90 days? Thank you for your help.

    When the divorce is final depends on the MA state law. In Florida, the divorce is official once the judge signs the order, not once you receive it in the mail, but MA law may be different. You should get in touch with an attorney in MA for guidance on this issue. I wish you the best of luck.

    If the papers were filed with the Court to initiate a divorce your fiancee will be served with those documents (either in person or via publication) in order for the case to proceed. If the divorce was already finalized and shes looking for a copy of the final judgment she should contact the Clerk of Courts in the Court where the case was handled in order to obtain a copy. This requires a waiting period of several weeks, but if she does not respond you will be able to proceed with the divorce.     Due to the fact that they are not married, the Father needs to establish his paternity via the courts in order to have the right to have time sharing with the child. Until that time she can of course allow him to see the child, but he doesn't have the right to visits. With this right also comes the obligation to pay child support.     If they file a Motion for Contempt there will be a hearing on the issue. The Court will likely only find that you are in contempt if they find that are you purposely violating the previous order. In order to prove that you currently don't have the ability to pay the $900, be sure to bring evidence of your current economic situation to that hearing. I wish you the best of luck.
