First, most banks will not consider a deed in lieu of foreclosure until the property is on a multi-listing for at least 90 days without an offer or a contract of sale. To do a short sale, you list the property at market value with a real estate agent who knows that you are looking to short sale it. Then, if you get an offer at that price or less and you accept it, then paperwork (a lot of it with...

First, both buyer and seller must have a lawyer to close on a house in NY, so please, call the lawyer that helped you negotiate the contract. But generally, the words "Time is of the essence" must be on the contract for a contract cancellation if not closed by the " Time is of the Essence date." Your lawyer will also check the contract of sale language to determine if incorrect property size invalidates the contract or makes it voidable.

If you and your husband are in agreement, mediation with a certified family mediator is a very good suggestion. If you have no assets, pensions and/or are willing to divide all the assets and agree, you can also obtain an uncontested divorce.

I do not know what type of case you have mediated or whether you attorney was with you during the mediation. I have attached a link below for the 8th Circuit, simply because it states that if your lawyer does not attend mediation with you, you have ten days to have your lawyer review the agreement. I am not taking a position in any manner, simply giving you information on the possibility that if it was a family mediatied agreement and if your lawyer did not attend. Meanwhile, why aren't you...

First you'll need to read your divorce agreement to see if there is a term of years that he is responsible for carrying the insurance. Since he did it for years and now says he doesn't have to I think you should check the papers first. Also, in the papers there will be a paragraph about the way to handle a default of any of the provisions. It might say certified mail and twenty days. Also, it might say thereafter that you should apply in x manner to the court showing compliance with the...

Your wife can take as long as she wants to answer your offer to delay the sale of the house unless you contact her (lawyer) and say that the offer is not available forever, and you would like an answer by a date that you specify. If you agree about the parenting part and can get a parenting plan signed, then you could work out the assets and liabilities at trial. How long that takes is a matter of the amount of assets you have and whether the income is earned by a business or w-2 earnings....

I agree with attny Heather. You just can't decide to walk away so you don't have to pay future support. The Court must determine the issue and most certainly you would be responsible for arrears.

If you went to mediation and it was an impasse, you'll be going to trial. I'm not sure if everyone at the mediation indicated how a mediated agt would be more beneficial than doing these next steps. However, mediation requires good faith on both sides. There are a lot of nuts and bolts details one needs to do after mediation impasse and before trial. I don't suggest that you go to trial without an attorney, let alone with the issues you raised here. You should review the retainer agreement...
