    Respondent was accused and convicted of 21 counts of aggregated stalking which subject him to removal. I successfully argued to the court that the language of the Florida statute defining agg stalking was vague in that any violation of injunction was a count of agg stalk with or without knowledge of victims presence. The crime of agg stalking is a specific intent crime, the language of the statute, without knowledge, essentially converted the crime into a strict liability offense eliminating the the required intent.

    LPR Respondent was found guilty of trafficking 25000 lbs of marijuana in 1984. DHS placed him in removal proceedings after applying pro se for natz. He showed great remorse and rehabilitation. Discussed in detail after his release he never allowed himself to be put in that position again.

    Former drug addict whom committed non violent offenses approx 8 years after receiving LPR. He was arrested in 4 year period 11 times for theft to possession of coke. Unfortunately he also suffered from throat cancer (in remission) which could not be directly related by medical evidence to his drug abuse. IJ believed as I did the his positive equities, length of residency, family ties and hardship to him outweighed his crimes as a result of his addiction .
