Description:Client was charged with tape recording a conversation with a Sheriff's Deputy, who was conducting a criminal investigation, without his permission. Although she did not have his permission, he testified he did not believe the conversation was private. As a result, we moved to dismiss the case on the grounds that the speaker did not have a subjective expectation of privacy and even if he did, it was not an expectation society was prepared to accept as reasonable.
