    Burglary while armed is a first degree felony punishable by up to life in prison. You do not have to have a weapon at the time you entered the premises, but you will still qualify as a burglary while armed because you became "armed" when the guns were picked up. FL. Statute 810.02(2)(b). If you are charged with any burglary (other than that of a conveyance or a structure), you will score a MINIMUM prison sentence. A simple burglary of a dwelling scores a minimum of 21 months in prison even if you have no prior record. When you start adding things like being armed, it changes the point system and you will be facing a much more severe consequence.

    The citation alone is enough for it to be constituted as being "filed." You just need to wait until it pops up on a court docket.

    Essentially, if you are "unavailable for prosecution" based on your own actions (here - voluntarily being out of the country), then the time is tolled and you can be prosecuted when you return to the State.
