Outcome:Although our client's advisory sentencing guidelines range was 57-71 months, we convinced the district court to impose 24 months of imprisonment with a recommendation that the client immediately be placed in community confinement.

Description:The Federal Bureau of Investigation and the United States Air Force Office of Special Investigations initiated an investigation against our client for the client's alleged distribution of child pornography. The government indicted our client on one count of distribution of child pornography, which is punishable by a mandatory minimum penalty of five years of imprisonment. We convinced the government to enter into an agreement by which our client would plead guilty to the lesser offense of possession of child pornography, which has no mandatory minimum penalty, and reserved the right to argue for a sentence that did not include a term of imprisonment.
