    the department of corrections would be the one who will provide you with a tentative release date...if there is an immigration hold, most likely the person will turned over to ICE after the release from the DOC

    Generally, if you are a first time offender, you may be eligible for diversion. It is up to the prosecuting attorney to recommend that you be placed into a diversion program. If such a recommendation is made, then you can apply to be accepted into the diversion program. A skilled attorney can help you get placed into this program. Some courts in Cobb County will only consdier allowing you to enter into a diversion program if you have an attorney representing your interest. Best of luck...
