  • Can the jail report use an obituary photo when running a story.

    Joseph’s Answer

i am licensed in Georgia and located in Augusta. I have a case presently that is going to put the Jail report out business for their malicious, false, and reckless reporting. they had no right in my view to run a photo of your deceased son who was no "in jail" or "arrested," since he in fact was a victim of a crime. Please visit www.neal-law.com. Call me. i will be glad to give you a free consultation to decide if its worth pursuing. Joe Neal, Jr.

My wife had her gall bladder removed yesterday. She advised the nurses who asked about her allergies that she was allergic to steri-strips (adhesive tape to cover incision). Two technicians (nurses I presume) advised they would use dermobond (an a...

    Joseph’s Answer

If her condition leads to a permanent injury that is directly caused by the steri-strips, then it could be a viable case. In South Carolina, as in Georgia and most states, a lawyer can not simply file a lawsuit alleging a doctor was negligent. The law requires an expert affidavit, that is, a sworn statement from a licensed and practicing physician, to certify that negligence actually occurred. This cost money. The expert has to be paid by the hour to review the medical records, which also cost money. Unless it is a case of obvious negligence, such as a sponge being left inside you, most malpractice lawyers will require you to pay for the records and the initial expert review

  • If both myself and my 18yo daughter are on her car title, am I liable if she is in an accident?

I just bought a used car for my 18yo daughter and it is currently titled in both our names; we both have individual car insurance policies. I am concerned that if she were at fault in an accident, I could also be sued since the car title is also ...

    Joseph’s Answer

In Georgia, a parent can only be held lliable for a child's negligence under the Family Purpose Doctrine, which is law in some other states. I am not sure what the law is in Wisconsin. Under Georgia, if the parent provides the car and insures it for the child and lets her use it for family purposes and she causes a wreck, the parent could be liable. Title ownership is not a key factor, but could be one of several factors to look at. Generally, if you dont live together, and you don't provide the car to her for family purposes, you are not liable for her wrecks.

Consult a Wisonsin lawyer but this should give you an idea.

  • What settlement to expect for 5% impairment rating?

Work related accident missed month amd a half off work. It was completely the other persons fault

    Joseph’s Answer

alot of factors must be considered. a 5% rating to the whole body? or part of a body? how much are your medical bills? lost wages? the impairment rating relates to the category of damages the law calls "pain and suffering," and depends on many factors, particularly the part of body and how it affects your life. give me all after reviewing my website, www.neal-law.com. i practice in Georgia and South Carolina. You definitely need a lawyer to maximize your recovery.

    Joseph’s Answer

It is not possible to evaluate the value of your claims without an in depth review of the evidence in your case, which consists of the damage to the vehicles, the manner of the wreck, your actual injuries as documented by the medical records, and any aggravating factors such as drunk driving on the part of the at fault driver.

I will be glad to review your case at no cost to you and let you know what i think it is worth, if your are in possession of the evidence above. If not, i would need to you gather this information on your own or hire me. I don't charge a fee unless i recover you money. Give me a call after reviewing my website. www.neal-law.com. I will be glad to help you if i can.

  • Is there a law in Georgia that says that if two parts or more of your vehicle is damage it's an automatic total loss?

I have gone to find different estimates but the insurance company won't budge. They only want to total my car and im still driving a 93 percent total car! Help!

    Joseph’s Answer

No. Total loss is determined based on the age and mileage of the vehicle, which determines its present value, in relation to the cost of repair. If the cost of repair exceeds the value at the time of the wreck, the insurance company will declare it a total loss, as the law alllows.

    Joseph’s Answer

If your daughter is still injured, she needs to get treated to be able to prove the injury from an objective medical provider. One time visit and no remaining problems is not something that typically warrants an attorney. The value of the claim depends on the amount of medical bills, lost wage (if any), and extent of pain and suffering. Call me to discuss the case. I'm licensed in South Carolina and do not charge for consultation in personal injury cases.
