    The second part of your question cannot be competently answered without a systemic review of the facts in your case. Typically, people have a greater chance of being found not guilty than they may realize, IF , and it is a big if, they get a skilled attorney involved early in the process and they cooperate with the attorney.

    Sounds like second degree forgery Second Degree occurs when you intend to defraud another by making, altering, or possessing any writing: in a fictitious name or

    in a way that the writing purports to have been made:
    a) by another
    b) at another time
    c) with different provisions; or

    It is a felony and carries a 1-5 year sentence.

    You can and should fight this DUI. In Georgia, an underage driver may be charged with DUI for a BAC of .02% or higher. Yours is higher but that does not mean you don't have a defense....you probably have several. Scientifically and medically, you were not under the influence at .038 and the penalties DUI are too long lasting to treat this lightly. Sadly, as a young Georgia driver convicted of an under 21 DUI.....even though you were not actually impaired.....you would get stuck with a criminal record that potential employers and grad schools can and will use against you. As a former DUI prosecutor and someone who regularly represents people charged with DUI in Gwinnett County I can tell you that it is worth trying to fight this DUI and that a skilled lawyer can help you. Don't let one simple mistake damage your future.

    Yes you can be charged but whether you can be convicted is an entirely different matter.
