    if the attorney "filed" a complaint on your brother's behalf the case may still be pending. you can search the court dockett and locate the file by his name. you may also contact the state bar to locate the person/ firm who took over the case files (if any).

    also if you can locate the person whom you felt had responsibility you may be able to contact the insurance company.

    i am guessing that not many people want to help b/c he was a passenger in a stolen vehcile ( i.e. that the recovery may be limited) who insured the car - that would be a start. you also may be faced with a statute of limitations issue in that you have waited too long to pursue the case. imho

    you need to go to a web site (NCDD.com) and select a lawyer in your area. based on third conviction in many states you will be prohibited from driving in any form for multiple years. my guess is that you will not drive w/ a valid license for a significant time period.

    i am betting that the letter you got from dmv only relates to the third conviction, not the statuts of the HV.

    call a lawyer in your area to get some info - usually the info is free

  • My DUI was reduced to reckless driving. I did not blow. Will my license still be impacted by the lesser charge?

    I did not blow at the scene took field sobriety and was charged with dui. The charge was reduced to reckless driving in Administrative court. Will my license be impacted?

    good news, if the dui was reduced by the judge at criminal court, not als, then there will be no suspension. if you or your lawyer got an agreement by the officer to reduce the dui to reckless it will have to be formally entered in criminal court (most likely state court or a city court judge)

    if i read you question correctly there was no als hearing based on the agreement.

    you license WILL be impacted only / usually to the extent of 4 points [you get 15 every two years before suspension] if you enter a nolo at the court you may not have any points at all

  • I am on probation for a dui in PA which i served 2 months for. I just recently got a citation in MD.

    the citation was for consumption/ posession of alcohol under 21. i did not consume any, i was just in the house, the cop wrote everyone citations. what will happen next?

    typically there would exist grounds for revocation, however it appears you have a very good defense. I doubt that Pa will have the officer from Md appear at a hearing sounds like you are safe.

    please go to the website NCDD.com and select an attorney in your area, typically the initial visit is free. he needs to talk to an attorney or it sounds like long term jail awaits around the corner. many attorney's in your area focus on only on this type of case. the cheapest thing he can have is a good attorney at any cost.

    very hard b/c the prosecutor will want to know why the battery claim was made. (i.e. if it was not true why was it made or if it was not true then someone lied.) in Ga the prosecutor is between a rock and a hard place (see my reasoing above) if the charge is dismisses and someone is hurt then blame will be placed on the prosecutor. on the other hand if the jury finds the accused not guilty then justice prevailed. imho

    contact the court (phone number usually on the tickett) and ask for mail in instructions. you also may visit the county web site for info. typically the court will not require you to appear. you may also want to call a local atty and ask if they practice traffic law, something this simple will usually get you free advice.

    you can contact your local dmv or look on the website of the md dmv. i suggest going to the NCDD.com website and locating an attorney in your area. this attorney can explain the issue b/c it is state specific.
