The first question I have for you is whether you served with a notice of forfeiture? The second question is why you've waited so long to seek legal assistance? Forfeiture actions must be initiated by the State in certain time frames. If an action is initiated, you only have a limited period to assert a claim for the property. Regardless, if your car was forfeited and there was a loan balance, the State is required to pay the balance, not you. You really need to get a lawyer to look over this matter immediately.

I can tell you what he should have done, he should have left as soon as he knew that his girlfriend was going to break into the house. He also should not have gone towards/in the house, since that act clearly makes him look like a party to the crime. Now that he is facing such a serious charge, the only thing he can do is make sure he has an experienced lawyer to help him fight the case.

  • How would his family have to go about getting him a lawyer? Would they have to go to Missouri or can they handle this in GA?

A friend of mine is in jail in Jackson,MO and his family wants to get him a lawyer. His family lives in Georgia.

    Noah’s Answer

They need a lawyer licensed in Missouri. If they don't know any lawyers up there I'd suggest calling the Missouri State Bar and asking if they have a referral service. If that doesn't work, there may be a bar association in the city where the case is pending that has a referral service. For example, in Georgia the Atlanta Bar Association has a referral service.

Habeas petitions are based on constitutional violations. Most habeas cases are not "reported" so you probably won't be able to search for "similar" cases. Did your husband an appeal?

    Noah’s Answer

It does not matter if you are charged with $20, $200 or even $220 since all would be misdemeanor crimes. If you want to get the case dismissed and prevent the case from being on your criminal history (and thus impacting your employment opportunities for the rest of your life) hire a lawyer.

If you were injured and you want to be fully compensated for your injuries, then yes you should hire a lawyer to represent you. The insurance company will never pay you the full value of your claim if you were not represented by a lawyer.
