    The issue here is that the portable breath test results that you're talking about are not admissible in court, except to say that you were "positive" for alcohol. It sounds like you didn't take a separate chemical test at the station. As for the field sobriety tests, there's nothing illegal about doing them in front of the patrol car like you said, but we could certainly cast some doubt on the officer's testimony at trial.

    You should be wary of any lawyer who promises a dismissal. The reality is that almost every prosecutor would rather go to trial and lose then dismiss a case outright. Reason being, if you ended up drinking and driving later and seriously hurt somebody, they would be responsible for dismissing this case rather than prosecuting when they had the chance.     This sounds like a case that should be reduced or dismissed. What happens from here will depend on several factors, including your history (if any), whether there was an accident (sounds like there wasn't), and who your prosecutor and judge are. I'm also interested to hear what the basis for the forgery charge was. That said, a good lawyer can give you the best chance at getting the prosecutor to do the right thing here.     It sounds like you have done a lot of things in advance to help yourself. That will certainly look good with the prosecutor and judge, just make sure you have good representation to present those arguments on your behalf. Unfortunately, they often do not take you that seriously if you are not represented.

    it can take a while for the report to be completed and filed, but the delay does not look good for the officer. It is meant to record the officer's observations while they are fresh in his or her memory. If the officer waits too long to write the report, it just looks sloppy and can be used at trial to cast doubt on what the report says.     I agree; you have nothing to lose by pleading not guilty and exploring whether a reduction to reckless driving may be a possibility (or consider fighting this at trial, if necessary). The Intox 5000 machine at the station does not give a BAC reading if you provided an insufficient sample, so I suspect there's more going on.     It sounds like it will be difficult for the state to prove beyond a reasonable doubt that you were under the influence of alcohol that made you a less safe driver. You'll be facing a possible suspension of your license, but a good lawyer should be able to protect your license and hopefully get your case reduced or get a "not guilty" verdict at trial. Consult with some attorneys and go with the one you're most comfortable with--you're typically much better off with good representation! Best wishes

    As I understand it, a DUI can make it very difficult to enter Canada specifically, as it is considered a more serious charge there. Typically, you should be able to travel while on probation if you notify your probation officer, but Canada may be a problem. Also, it sounds like this is your first court date coming up? If so, you shouldn't assume that the case will be resolved on that date. Typically we would enter a "not guilty" plea as an initial matter and that allows time to investigate...
