  • I Failed a Drug Screen During my Pre Trial Diversion in Milton muni court. I had completed all of my community svc & fines.

I am an 18 yr old female and am really trying to get my life together. I am working on my GED and applying for jobs - but don't know if I can accept one with this issue still out there. What will happen now? Will I go to jail??

    Justin’s Answer

I agree with the answer above. If it were me, and I were you, I would go and get independent tests on a weekly basis to show that you are no longer using and abstaining. That may help you to continue in the program and potentially not get revoked.

  • I missed the 10 day deadline for a DMV hearing by 1 day. Is it possible to still get a hearing?

    Justin’s Answer

At this point, your only chance will be to file a motion to withdraw the plea. Any guilty plea to a moving violation that occurred while on your limited permit will result in a six-month revocation of that permit.

While the chemical evidence is unfavorable, you have a number of good legal issues to challenge. Issues like articulable suspicion for the stop, the point at which custody attaches, and substantial compliance with the HGN to name a few. Hire the best DUI attorney you can afford to fight these charges, Good luck,

  • Do I need a defense attorney?

Another driver and I got into an altercation. she was driving in front of me and kept slamming on her breaks trying to get me to rear end her. I made a couple attempts to get into the other lane to avoid her. I was having a hard time in my life an...

    Justin’s Answer

Absolutely. You have a few issues here. It would not be wise to speak with the Detective or any Law Enforcement Officer without proper counsel. Additionally, at this point, a lawyer may be able to get you a pre-set bond you can book in and quickly be released. You then will need to have counsel present to handle the underlying criminal matter. You have gotten to this point on your own, but certainly should take a step back and retain an attorney to help mitigate and manage this situation. Most of us will be happy to chat with you over the phone to determine the best course of action.

  • Public intoxication in GA DeKalb

I got a citation for public intoxication 16-58 (local ordinance) yesterday. I was out with friends and we had a fight over something and one other friend called 911. We both were bruised up after the fight. I have only had 2 drinks (I told officer...

    Justin’s Answer

You have been cited for a local ordinance. Your case will be handled in Dekalb Recorders Court. Any criminal conviction can have a negative impact on your status in this Country. But that would be a better question for an immigration attorney. The goal should be to hire an experienced criminal defense attorney to review the evidence and work with you to ensure that this does not end up on your criminal history. Remember that an arrest is not a conviction and your next step should be to consult with an attorney to review legal options and work towards keeping this off your record.

  • I was involved in an accident and i left i had a shot of whiskey after i got home how can they charge me 4 dui

how can they prove i was drinking at the time of the accident. I refused to blow breath test

    Justin’s Answer

Unfortunately, they can charge you with whatever they want. Whether they can prove it or it will stand up in court is an entirely different story. Remember it is the State's responsibility to prove every element of DUI beyond a reasonable doubt. It sounds like they may have trouble proving you were in fact under the influence of alcohol at the time of the accident. But then again, they may try to presume and prove that the reason why you left the scene was because you were impaired. Whatever the case may be, the best thing you can do is hired an experienced DUI attorney to fight the case for you.

  • In ga. After 1st dui offence and blowing .01on breath test I was arrested and blood tested license was seized

I was issued 30 day temp permit to drive and court dates not for 60 days what do I do after temp expires until I go to court to drive ?

    Justin’s Answer

If the officer seized your drivers license and issued you a notice of suspension along with a temporary driving permit, you will need to file an appeal to this action within ten business days from your date of arrest to ensure your license is not suspended. Otherwise, your license may be suspended for a period of one year. Sounds like you have some strong legal issues to challenge in your case. Contact an experienced DUI attorney to help you through.

  • I got a DUI .152 what will happen to me?

This is my first time ticket , I even know what to do. I'm looking for a lawyer... I got arrested in Delkab county... If I don't have any record this could count for them

    Justin’s Answer

It depends on a whole host of issues. Whether the officer had a reason to stop you, whether he had probable cause to arrest you, whether he read you implied consent before requesting a test of your breath. The best thing you can do is contact an experienced DUI defense attorney and review your case in detail. We offer free consultations and are more than happy to assess your case and discuss likely outcomes.
