State v. Bruce K.

David Michael Zagoria

Case Conclusion Date:February 17, 2005

Practice Area:DUI / DWI

Outcome:Not guilty of DUI

Description:Bruce was riding his motor cycle and stopped for speeding. The officer had him perform field sobriety evaluations, concluded he did poorly on them and asked for a breath test which Bruce refused. The Judge suppressed the refusal of the breath test at the conclusion of a pre-trial motion to suppress hearing. The case went to trial. We hired an expert on field sobriety evaluation to counter the arresting officer's testimony. The jury found Bruce not guilty of DUI.
