    Wal-mart has a reputation of fighting claims very hard. You should talk to a lawyer who is experienced in handling fall cases.

    You should take prompt action. Have you reported the wreck to your insurance carrier to preserve UM coverage? That should be done ASAP.

    The answer is always "It depends." How much insurance does the driver have? The more in coverage, generally the longer it takes. You are not at "maximum medical improvement" so neither your lawyer nor the insurance company can clearly assess the value of your damages. The DUI element is a big issue in evaluating your damages but not the only one. Even a "quick" settlement can take 6 months to a year.

    I'm very sorry to read about this. Best wishes to your son.

    The issue whether legal action can be taken depends on whether there was something wrong with the cart or whether there was something on the floor that caused the cart to tip. Kroger has video cameras that records events. You need to take immediate action to inform Kroger to preserve the video if you feel there was something wrong with the cart or poor maintenance of the floor.

    I just finished a trial last Friday against Kroger where no videos were preserved. If you'd like more information, please contact our office.

    The likelihood of a recovery depends on a lot of information not contained in your post.

    Such as the speed of the other car, the damage done to your car, the amount of medical care needed and the length of time your injuries affect you.

    Sometimes minor injuries turn out to be more significant than first expected. However, insurance companies will argue that if you didn't go to the doctor or didn't follow up with another doctor than you must not of been in pain. Even a week or 10 day gap in follow up care might be used against you.

    If you are feeling better every day, you may recover something for the initial harms. The recovery depends on the significance of the harms.

    Are you asking from the standpoint of pursing a civil claim - for money damages?

    Generally the statute of limitations in Georgia is 2 years. It may be longer under some circumstances.

    It depends on who you work for and who was responsible for property management / the wet floors. In Georgia, if your employer was responsible for the property management you are likely barred by Worker's Compensation statute. However, if you worked at an office building for a architect and slipped in the lobby - the office building owner and property manager can be sued.

    It is also very challenging if you didn't report the fall right away. It can sometimes be overcome but it raises suspicions.

    You have a police report. Take photographs showing the damage done to your car.

    You'll need an experience trial lawyer to represent you if the insurance company is denying liability. You should ask lawyer about trial experience.

    Evidence can disappear if you don't hire a good lawyer to preserve it.
