It is not as easy as simply signing over a parent's rights to a child. In Georgia, both parents are deemed to have an obligation to the child. Georgia courts will not do anything regarding establishing parentage until the child is born. Also, in order for one parent to give up their rights and obligations to the child, Georgia generally requires a second or step parent who is willing to step in as an adoptive parent. Also, in order for a step parent to adopt, generally the biological parent...

Based on the additional information you added in the comments to another attorney's response, the county sheriff probably wasn't looking to serve papers from another county, but to serve the warrant itself. Service can be accomplished by leaving papers at someone's residence with a person of suitable age who also lives there. It seems the sheriff kind of has a hunch your dad is already there. If you don't want to get in trouble for harboring someone or assisting him in hiding (or if you...

The portion of the prison term she will serve depends entirely on the pardons and parole boards evaluation of her case, her risk to the community, and how much room there is in the prison system at any given time. Certain offenses are automatically going to require that at least 65% of the term be served. Other offenses may require less. Look at the link I've included for the parole grid effective as of 2013 regarding the general time served for certain offenses.

Under your insurance policy, you have a duty to report an accident/claim to them within a certain amount of time. In general, your policy won't go up if you were not at fault for the "accident" (in some states there is legislation that says as much). Did you file a police report when this occurred? Did the business give you their insurance information? If not, try to get it. if they have admitted it was their fault to you verbally, that is very different than doing so in writing. Try to...

Your best bet is to contact a local workers compensation attorney for a consultation. They can help you navigate the workers compensation system in a way that help you get the help you need and makes sure your employer doesn't neglect your medical needs. Best of luck.

Consulting with an attorney in your area is key. The other driver will have attorneys associated with the insurance policy and the rental company. Without an attorney on your side, it is doubtful you will be able to get them to pay.

  7. Do I have a solid medical malpractice case if my doctor was indicted (and is currently in jail) for prescription drug crimes?

It is possible the indictment of the doctor could help a malpractice case...but only if there is indeed a valid malpractice claim. When you are prescribed medication and you fill that medication, it comes with significant warnings and usage considerations when you pick it up at the pharmacy. Most pharmacies today require that you either consult with the pharmacist or waive consultation and assume the risk of not receiving that information orally. Even if you waive consultation, the leaflet...

you should qualify for record restriction and possibly for sealing the court records as well on some if not all of your cases. Check out the website I've linked for information on qualifying and how to go about requesting restriction, etc.

  9. In GA is a person who is 16 charged as a juvenile or an adult for burglary? The total amount for items stolen was over $10,000.0

If this is the juvenile's first (or second, or third) burglary, they will be tried as a juvenile. However, if this is the fourth burglary and the first three were adjudicated at separate court appearances, the Court is required to transfer the case to Superior court and, in that case, a child over the age of 15 will be charged and prosecuted as an adult. I would be happy to speak with you if you'd like further insight. Best of Luck, Lisa Harris

My colleague is correct in her assessment of your situation. In addition, a judge is not listed in the Georgia State Code as being required to report a suspected case of child abuse to DFCS. If indeed you think there is, without question, an issue of child abuse, evaluate carefully what DFCS might be able to do for you. In general, I think a guardian ad litem in your custody proceeding may afford you a better outcome than getting DFCS involved. Procedurally, DFCS would investigate, talk to...
