    I agree with other attorneys who have commented. The fact that your Miranda Rights were not read does not provide any kind of viable defense for cocaine being found in your pocket. The Miranda warnings only become an issue if the police interrogate you and you make any type of incriminating statements. I also agree that in GA for a first-time offense with a small amount of cocaine that your attorney should easily be able to get you into a Diverison program so that the charges may be...

    Have a lawyer with you for sure. I would not make the mistake of not going to the new court date because of the warrant. That would certainly make matters worse. Given that you could be arrested when you do appear in court though, I would definitely suggest having an attorney there with you. The attorney may be able to work out a reasonable bond for you.     I would certainly suggest hiring an experienced attorney who handles, or has handled, similar cases- particulalry for your brother who is already on probation. There is a lot at stake here.     The Statute of Limitations for your class/type of case is 4 years. It definitely sounds like the state is within the statute of limitations. A plea to any charge, however, should not be taken lightly. Make sure that your attorney has explored any possible suppression issues and be sure there are no equal access concerns.     I would have to agree with the other attorneys that have chimed in. As long as you follow what the Order requires you to do, you are not in Contempt. I would make sure your Ex has your contact information; but it is completely up to the non-custodial parent to initiate visitation if he so desires. You are under no obligation (unless your Order states otherwise) to intitiate such contact. Good luck!
