With the current state of affairs with police officers and Black American, as the parents of a young Black male that has never, ever, been in trouble with the law and had just graduated from a prestigious University in Atlanta Georgia, it was mind boggling when he was pulled over in Georgia for what I feel was being “Black and driving a nice car”, it was the most frighten thing for us to get a call from our son stating that he had been arrested.
He was taken to a police station and was not allowed to call his parents. It was only through persistent calling to the police station that we found out that he needed a telephone account to make calls outside the jail to his parents. We didn’t know the charges, reason, or what was happening to our son. I immediately started to research the lawyers in that area that could handle this case and tell us what was going on with our son. We contacted the Law office of Howard J. Weintraub at 11:45 p.m. We knew it was very late and was hoping to receive a call from him the next morning but approximately 30 minutes later at 12:15 a.m., Howard called us in regards to our son. We were totally shocked that a lawyer would call us at that early time of the morning. Howard did not make any guarantees or promises to us. He explained the legal process to us and told us what to expect. He met with our son at 8:30 a.m. that same morning and went over the case with him and with us. Once again, he never made any guarantees or promises to us or to our son but he did say that he would do everything in his power to get the charges reduced and eventually dismissed. Our son was facing felony drug charges and vehicle violations (tint to dark in car).
After our son returned home, we were thankful that he did not end up hurt, beaten, or worst dead as a result of what happened on interstate 85 with these police officers. Howard and Ben were a life saver and life line to us and the legal system. Howard never panicked, worried or stressed but kept us focused on taking care of our son and he and his partner, Ben, taking care of this case.
Race, social economic status, education, or religion did not matter to Howard and Ben, only ensuring that our son got the best possible legal representation. They fought for our son as if he was their very own relative and they always followed up with us 2-3 times a week letting us know what was going on with his case. I know that isn’t the norm for lawyers but it was for Howard and Ben.
In the end, all felony charges have been dropped and he was approved for a diversion program and once that is complete, his record will be expunged. Howard and Ben did assure us that their work would not be completed until every “I” was dotted and every “T” was crossed for our son and his record is expunged.
If you want a lawyer that will speak the truth, not BS you, and fight for your rights, then you want Howard and Ben as your lawyers. It’s not a black or white thing for them, it’s the right thing. This amazing Atlanta law firm looked beyond race and saw our needs…….and we thank God every day for them. They will always be a part of our family.

Several months ago, I found out that the United States Government had seized my bank account and thousands of dollars of my money even though I had done nothing wrong. I had no idea what to do or how to fight back. I also feared the Government might try to bring criminal charges against me! I contacted The Law Offices of Howard J. Weintraub, P.C. and quickly retained them to help me. Howard and Ben were great throughout the process. They spoke to me for hours about my case and had me put together lots of documentation in support of my defense. After all, this was my hard-earned money! Howard and Ben initially calmed my fears by convincing the prosecutor not to pursue any criminal charges against me. However, they would not settle for that and demanded that the Government return my money. After several rounds of negotiations, Howard and Ben convinced the Federal Prosecutor to return every cent of my money! I cannot thank Howard and Ben enough. They took a very stressful situation and took care of me and got me the best outcome possible. If you ever need an attorney, contact Howard and Ben immediately!

HOWARD WEINTRAUB AND BENJAMIN ALPER ARE PHENOMENAL ATTORNEYS
I am the owner of a business that is highly scrutinized by both Federal and State of Georgia regulatory agencies. It is my obligation to be fully aware of the morass of regulations, wherein a knowing violation of a rule can expose me to both civil penalties and a criminal prosecution, that could place me in prison.
Last year I found myself in a situation wherein it may have been deemed by federal government attorneys that I had violated a regulation involving my business. Although I truly believed that the regulation did not apply to the situation I had been involved in, I nonetheless realized that government lawyers could conclude otherwise. Therefore, I called Atlanta criminal defense lawyer Howard Weintraub. Over the past several years, I had been Howard’s client for civil matters and he always accomplished successful resolutions of the particular matter. There was no doubt that Howard Weintraub and his partner Benjamin Alper were the go-to attorneys for this potential criminal prosecution.
After calling Howard, as is his usual and customary style, Howard and Ben immediately jumped into the case. After conferring with me to obtain a detailed understanding of the facts, Howard and Ben researched the federal and state statutes and regulations and they decided that I had not violated any laws. Howard and Ben then very quickly decided to confront the issue head on with federal government attorneys. They therefore brought the issue and my conduct to the attention of the federal government officials rather than waiting for the officials to perhaps someday notify me that I may have violated the law. A gutsy strategy to say the least, but one that I wholeheartedly endorsed as I was innocent of any knowing wrongdoing.
The strategy worked brilliantly and I received a clean bill of health from the government. I cannot thank Howard Weintraub and Benjamin Alper enough for their incredible representation of me. Although their services came with a financial cost to me, Howard Weintraub and Benjamin Alper are worth every dollar of their fee! I highly recommend Howard Weintraub and Benjamin Alper to anyone in need of highly gifted, aggressive and extremely dedicated lawyers who will fight to protect their clients.
Thank you again.

I recently had a civil matter concerning my daughter. She had gotten involved with the wrong crowd, was under age, and 21 year old convicted drug felon guy decided that he was going to harrass her. I tried to work with Fayette county to obtain a restraining order. The only thing I received from Fayette county was a run around. The county was terrible and wouldn't even take the time to speak with me. They insisted that I hire an attorney in order to file for a simple restraining order. I was referred to Mr. Weintraub by a co-worker. Although Mr. Weintraub didn't practice in Fayette county, he took the time to educate me on how the legal process worked. With this knowledge, I was able to call the county and work around their incompetenance and/or lack of concern for taking care of their taxpayer. I was able to obtain a restraining order and the guy has backed away and is leaving us alone. During this process, Howard constantly followed up with me and asked how things were going. His compassion and numerious calls just to check and make sure things were okay and to see if I had any questions was some of the best customer service I have ever received. He genuinely cares about his clients. Once everything was said and done, he wouldn't even take a dime for his much needed assistance. I thank you, Mr. Weintraub, for being a kind, professional and compasionate human being and I am so greatful that you were there for me and my family.

In November 2013 I received the phone call , from my son, that no mother wants to receive. It was my 20-year-old, college sophomore, and he had been arrested in a small town in southern Georgia. He was pulled over for speeding and the officer said he smelled marijuana and searched the car. In the search a small amount of marijuana was discovered in one of the passengers back packs. Because no one claimed ownership of the drug all 5 people were arrested for possession and as the driver of the car criminal liability was placed on my son.
My son, who is an honors student, athlete and who had never been in trouble before was in jail for marijuana possession. His goal is to work for the State Department after graduating and this arrest could have a devastating impact on his future.
We needed a lawyer and we needed a GREAT one! Howard was recommended to us. The arrest happened over a weekend and we called and left a message on Saturday. Sunday morning bright and early Howard called us back. He actually apologized for not speaking to us on Saturday as he was at a family wedding! We talked for close to an hour and needless to say, that phone call left me with a sense of hope that I had not felt in 24 hours.
My son, husband and I met with Howard and Ben the next day. They spent a great deal of time getting to know my son and his character. They also discussed, at length, the charges and outlined a plan to get the charges dropped and expunged from his record. There was no guarantee but we left that meeting hopeful and knew we had the best lawyers on our side. Howard and Ben made us feel confident for our son's future.
The case dragged on for a year (small time court system) but the whole time Howard and Ben were in touch with us. We were given the best news before Christmas that our son would have to pay a speeding ticket and the drug charges were dropped and would be expunged from his record. He never even had to step foot in court. This happened just in time for him to be able to leave the country, last week, to study abroad for the semester.
Howard and Ben you saved our son's future! We are so grateful Thank you!

In reference to my previous review about 5 months ago I had said that I would update my AVVO review as the case continued. Today I am pleased to say that I am the happiest man alive and that I owe my life and freedom to the Weintraub Team ! It has been a very long 7 months since my arrest, unsure of how my life would end up with this possible felony record hanging over my head. Throughout this time The Weintraub Team has worked tirelessly to get the results desired. A few days ago I received a call from Howard personally explaining to me that he was successful in getting the ADA to drop my case. WOW I was in complete shock ! He never made any promises to me about the case but always reassured me they would fight for me for the best result possible ! That is exactly what the TEAM has done ! I CAN'T POSSIBLY THINK OF A BETTER CHRISTMAS PRESENT AND BY FAR THE PERFECT WAY TO START A NEW YEAR ! Many THANKS go out to Howard, Ben, and Pat ! I don't believe there is another Law Firm out there that is as busy as The Weintraub Team yet stays in contact with their clients and keeps them updated as to the results of their current case as well as these guys do. If you have any question on who to hire for your criminal case, your search ends here ! I highly recommend the The Weintraub & Alper Team ! IT DOESN'T GET BETTER !!!!

Two months ago, I called The Law offices Of Howard J. Weintraub with a very heavy heart. My younger brother, my only brother had been picked up in New York City for Violation Of Probation. He was subsequently extradicted to Georgia where the original conviction took place.
My family and I didn't know where to turn as we live in NYC and were not familiar with any law firms in the Atlanta area. I spoke to several Atlanta attorneys - and then, I spoke to Howard Weintraub. Within 10 minutes, I knew this was the man my family and I wanted to represent my brother. I was so impressed with his sense of professionalism and his proposed strategy that I was confident he would prevail. My brother was facing serious prison time as this was his third arrest for the same criminal offense. The D.A. not only wanted a considerable amount of incarceration (up to 10 years) but he was determined to place a felony on my brother's record that would follow him for a lifetime.
Howard communicated his strategy to me in detail. He made no false promises but his plan for my brother's defense was brilliant.
My confidence and trust in him have proven to be right. Not only did my brother not get prison time but after the firm's presentation, the judge decided not to place a felony on his record.
My family and I are very grateful to the law firm of Howard J. Weintraub. They truly deserve the excellent ratings they receive. Howard Weintraub kept us informed and calm. He has a wonderful sense of humor and a total lack of pretention but when it comes to defending his clients, he knows how to go for the jugular.
I would highly recommend this firm to anyone who wants the best defense possible.
Thank you Howard.

As a former attorney, I have know many lawyers. Mr. Weintraub's knowledge of the law, the local legal community are unsurpassed in the Atlanta area. Further, Howard's ethics, honesty, dedication and concern for his clients, are unparalleled. Long after my need for legal assistance was over, Howard still checks on me from time to time, much like an brother would. I would recommend his services to anyone in need of counsel. Lastly, I would like to say," The Chief knows both sides!"

Several months ago, while I was driving my car in Georgia, I was pulled over in the afternoon by a police officer who claimed I had an improper level of tint in my windows. After speaking with me and the passengers in my car and with the officer claiming that he smelled an odor of marijuana, my passengers and I were ordered out of my car. A search of my car then took place and the police found a quantity of marijuana in the trunk, together with a firearm and a weighing scale. Although these items did not belong to me, the officer arrested me and I was facing felony charges of being in possession of a firearm during the commission of a drug offense and possessing marijuana with the intent to distribute. Although my car was occupied with two passengers, the police placed criminal liability on me.
As a young college graduate with a promising career ahead of me in the legal profession, I knew that this day had become a life-changing moment for me and I knew that I needed to retain formidable criminal defense lawyers in Atlanta to help me through this crisis. After making the dreaded telephone call from jail to my parents to advise them of my arrest (my first lifetime arrest) my parents searched for a criminal defense lawyer. At approximately 11 p.m. that evening my mother emailed the Law Offices of Howard J. Weintraub in Atlanta briefly stating my situation and requesting a call from the attorneys when the office opened the next day. To my parents’ amazement and relief, they received a telephone call from Attorney Howard Weintraub himself within a few minutes from when the email had been sent! Howard Weintraub spoke with my parents concerning the legal procedure that I was facing and he took great care at the midnight hour to allay their fears and anxiety. Mr. Weintraub discussed with my parents the law concerning vehicle stops and vehicle searches, and discussed other matters with them. Mr. Weintraub also commiserated with my parents about the devastating impact of the arrest on my future career and he offered relief to my parents by generating a plan – if it worked – that would enable me to forgo a conviction and have the arrest expunged from my record. Although he was careful not to guarantee this result, he was hopeful that he could pull it off. Guess what? Howard Weintraub and his partner Benjamin Black Alper pulled it off!
Howard and Ben hit the ground running the next day after I made bail and was released from jail. First, Ben and Howard met with me in their midtown Atlanta office for a conference that took several hours. At this meeting, Ben and Howard went through the facts of my case in painstaking detail. They also took the time and effort to learn about me and my background so that they could explain to the prosecutor that I was not a criminal. After the meeting I felt relieved and I was so thankful to have not one but two smart and tough lawyers in my corner.
Howard and Ben routinely kept in touch with me about my case and their progress. Howard and Ben explained that the first step would be to get the felony charges reduced to misdemeanor charges. The prosecutors initially offered to let me plead guilty to the felony charges with a sentence of five years of probation. Howard and Ben would not accept that. After a few more rounds of negotiations, Howard and Ben convinced the prosecutor to drop the charges to misdemeanors. A second prosecutor then came onto my case and offered to let me plead guilty to the misdemeanors with a sentence of one year probation. Howard and Ben would not accept that. After further negotiations and a lengthy presentation to the prosecutors about my character and background, Howard and Ben convinced the prosecutors to let me resolve my case by entering a pretrial diversion program, allowing the charges to be totally dismissed and the arrest expunged from my record: the best possible outcome! Throughout this ordeal, I was so impressed
