  • I am in desperate need of a medical malpractice attorney but I'm having difficulty finding one are there any available?

I had surgery on my hand a broken finger March 20th, it has continuously become reinfected constantly because I begged the original surgeon to remove the Deep Tissue sutures that were causing the infection and rather then do what I asked him to do...

    Mary’s Answer

I am sorry to hear of your injury to your finger and the recurring infections. I can imagine how difficult it must be to care for your two boys with that kind of injury. Medical malpractice cases can be very difficult and expensive to prove, which may be part of the reason you are having trouble obtaining representation. There may also be other reasons why, but more information is needed to evaluate whether you might have a medical negligence case that would be provable. You mentioned $15,000 you paid out of a settlement. It doesn't sound like the settlement was reached in connection with your medical negligence complaints, but, if so, you may have released any claim you have against this doctor for malpractice.

I am sorry to hear of your collision and injuries. You need to get treatment. You may have more serious injuries than you are aware of. Also, if you are injured and don't get treatment the insurance company/defense will argue that you were not really injured. They will use that as justification for not paying as much as you might be entitled for your injuries. You need a personal injury attorney to help you with your case. There are potentially punitive damages available and, as others have stated, the insurance company will not take you seriously if you are not represented. Most, if not all, of us offer free consultations and work on a contingency basis, meaning you won't owe us anything out of pocket and we only get paid if we recover for you. You have nothing to lose, but potentially much to gain by reaching out for a consultation.

The other side will argue it is not related, of course, but if your fall was caused by your automobile collision related injuries, it is. You need a personal injury attorney. Most, if not all, of us offer free consultations, so you have nothing to lose but much to gain by reaching out to an attorney. Most, if not all, of us also work on a contingency fee basis.

I was attacked and shot at a apt complex. I have just found out the policy wont cover med bills. I have not seen the actually policy but in the denial letter that was stated. I am wondering if I can still sue them for my med bills, lost of pleasur...

    Mary’s Answer

Whether you can recover will depend on the circumstances of the shooting, but, yes, you very well may be able to sue for negligent security as a result of the shooting, especially if the apartment complex had a history of a high crime rate and failed to take adequate measures to prevent crime. Given the potential seriousness of your injuries, you should definitely consult with an attorney in your area as soon as possible.

  • On Oct 9th 2014, while visiting family in Villa Rica GA, my husband began to experience severe chest pain. I took him to the ER

They were made aware immediately that he had been recently diagnosed with a leaky heart valve and an aortic aneurysm. We arrived at about 9pm and he died at 2am. We were kept waiting in the waiting room for hours because they did not have a heart ...

    Mary’s Answer

I am so sorry to hear of your loss. You should definitely consult with a medical malpractice/wrongful death attorney in Georgia. I see you posted your question in Atlanta which I'm sure you know is close to Villa Rica, and there are many of us here in Atlanta and in surrounding areas. A medical malpractice attorney can review the medical records and provide them to medical professionals who can provide an opinion regarding whether the applicable medical standard of care was violated. Most, if not all of us, provide free consultations, so please do not hesitate to reach out for an opinion. Again, I am so sorry to hear of your loss.

  • In a civil case, if I drop the charges against the defendant, can the defendants lawyer make me responsible for attorneys fees

I got hurt in a car accident and dealing with the defendants lawyer (Insurance Company). I got a ridiculous offer of $ 500.00, but have medical bills of $20K. I would like to refuse the $500.00 offer, and make a much higher counter offer t...

    Mary’s Answer

You need to hire an attorney. If the other driver was at fault and you have $20K in medical bills as a result of the wreck, $500 is a ludicrous offer. The insurance company lawyer is not taking you seriously. Please do not continue trying to resolve this case on your own. Call one of the qualified personal injury attorneys on AVVO. Most, if not all, of us provide free consultations, so you have nothing to lose and potentially much to gain by reaching out to one of us.

    Mary’s Answer

I agree completely with all of Mr. Summers' comments. You need to contact a medical malpractice attorney and obtain your medical records, which absolutely do belong to you. An attorney can help you obtain them if you have any trouble getting the doctor and/or hospital to release them.

    Mary’s Answer

I agree with my colleagues. Your father should notify his insurance company and contact any attorney to help him through this process. If the other driver was at fault, the driver and their insurance company will be liable for your father's injuries. If their insurance is inadequate to cover his injuries, your father may have uninsured motorist coverage that will provide additional coverage. An attorney can help identify all potentially relevant insurance policies and guide him through this tragic event.

You should look into the National Vaccine Injury Compensation Program. It is a federal program set up to compensate patients who are injured by adverse reactions to vaccines. The website is:
http://www.hrsa.gov/vaccinecompensation/index.html. If you want a lawyer's help, you will need a lawyer admitted to practice in the federal program. You can find a list of lawyers through the website.
