    Your attorney should promptly respond to your calls, and, in my opinion, should ask the defense attorney for an explanation. In similar situations, I've sent emails to the defense attorneys requesting an explanation, and I copy my clients on the emails to keep them in the loop. Good luck to you.

  • Is it true that the state of Ga no longer settles claims with state employees?

    I have spoken to attys who won't take a case if you are or were a state employee. Reason stated is that DOAS will not settle, they would rather pay weekly amount for maximum. Is this true?

    I currently represent several state employees and I've m represented several others over the last 5 years. The state rarely settles cases these days, but to my knowledge, they don't have a blanket policy against settling every case. While some attorneys won't take state cases, there are plenty of excellent attorneys that will. Good luck.

  • We are in Georgia and my wife has been out of works comp. for approx. 1 year and she has returned to work with forms 240.

    Since she has gone back to work with forms 240, is she entitle to receive any other disability payment in a reduced amount from the company while she is working? If so, how should she ask the company?

    Yes, she would be entitled to Temporary Partial Disability Benefits based upon the facts that you have presented. In addition, there are other factors that your wife must considered such as the consequences of performing the modified duty job for 15 or more consecutive days, and conversely, the benefits to which she would be entitled if she is unable to perform the job for 15 or more consecutive days.   • My Georgia attorney & I signed off to mediated worker comp settlement Jan 24,2014.Worker comp has not signed.Do they have to?

    Either party can withdraw from a settlement unless and until it is signed by both parties AND approved by the State Board of Workers Compensation.     "Fault" is not the legal issue in a workers' compensation claim; the issue is whether the accident arose out of and in the course of her employment. I would be happy to analyze this issue, but need more information. What was her job? Why was she changing shoes? And when and where was she changing shoes?
