    What the other attorneys have advised you is the black letter law - the law that is in the books. However, there is some interesting case law in Georgia - Children lived with their mom and step dad for many years. Mother died and the Legal father wanted custody of his children. However, the court gave the children to the step dad. Those facts are not exactly your case, but similar.     In the State of Georgia, adult adoptions are allowed and in fact there is a special statute for them. What you need to be asking is, what requirements does your brother's insurance carrier to give you coverage? There is no requirement in Georgia to notify or obtain permission from your birth parents.     Yes, it will impact the petition you are filing for your husband. However, having a payment plan will go a longway. A payment plan with the IRS and a strong affidavit of support - more than the poverty guidelines, will definately put your case back on track. Good Luck

    Asylum applications must be filed within one year of entry. There is an exception - if the conditions in your country recently changed and you are adversly affected. Asylum cases are tough and filing a case after the first year must be prepared with a great deal of care to show how recent events impact you.     I understand your concern for costs, especially when money is tight. However, I have seen too many cases where families pull forms off the internet and then have nothing they can take to court. Contact an adoption attorney in Seattle and ask if he or she can take the surrender/consent of the biofather and later do the stepparent adoption.
