    Call the county where you were placed on probation. The local clerk's office may be able to tell you if you have a bench warrant for your arrest. If there is a warrant, call a local criminal defense attorney from that county. If you use Avvo, put in the town the county courthouse is in and it will give you a listing of attorneys in the area.

    Well there is a couple of defenses here for this DUI. While I appreciate Michigan attorneys trying to help out here in Ga, your friend will need a local experienced DUI attorney to defend his case. It is his best chance to put this behind him. The police will need to prove that your friend was driving the vehicle. He needs an attorney as soon as possible.

    Lawyers have a set protocol on where they appear first when they have cases set at the same time which is a Superior Court rule. Felony cases come before misdemeanors. You should contact your lawyers office to see if they still represent you in your DUI case. Just because your lawyer cannot appear on Monday does not mean you will not have a lawyer on a later date. It is important that you speak with your lawyer to figure out what you need to do next to resolve your DUI case.

    Will getting my license back before court help any since I was ticketed for no valid drivers license and not driving on a suspended license (40-5-121). Im nervous and dont know what to do.

    Its okay to be nervous. Wondering what is going to happen is part of this process. There are a couple factors at play here. You actually dodged a tougher charge because Ga no longer has to prove service. The officer in your case gave you a ticket for no valid license which is much better in the long run. The fact that you have your license back when you go to court will go in your favor. Most likely you will have to pay a fine. A consultation with a local criminal defense attorney will help you understand what you will likely have to pay. In our jurisdiction the fine for your offense can be $280 all the way up to $700 depending on the type of court. Find an attorney in Columbus that you can consul with to set your mind at ease.

    i was arrested for dui last nite and the arresting officer didnt give me the DS 1205 form nor did he keep my license , do i need to file a written appeal and request an ALS hearing ?

    This is happening more and more often in my DUI cases. While it is unlikely this officer will file the 1205 later, I normally suggest that you file the appeal as insurance against that unlikely occurrence. If the 1205 is never filed, you can apply to get your $150 back for the appeal.

    If you have been convicted of DUI for a 2nd time within 5 years between the 2 arrests, then you will have a hard suspension of your license without a limited permit. This will keep you from driving an ambulance or firetruck and may curtail your job prospects. I agree that you should talk with any future employer about your chances with a conviction. If you have not been convicted of this 2nd DUI, please speak with an experienced DUI attorney regarding your case. You may have other options.

    You can send the paperwork back with a copy of the subpoena on top or you can call the law office and request the contact person on that case.

    My best advice to you is too find a very accomplished DUI attorney in WI to handle your case. This is the best money you will spend to try to avoid this consequence. If you cannot find one, I know two great ones and would be happy to share this information with you. This is your future. Make sure you have a good attorney to assist you.

    It is hard to tell based on what is above, but it sounds like your case was closed after you served your detention time. It is unlikely that arrest will be able to be expunged. As for the police department hold, I would try to get a copy of your court documents that show exactly what happened to your probation. You may be able to pursue expungement of the arrest with those documents. An experienced criminal defense attorney could look at the documents and let you know if you would be eligible for expungement.

    The Court may or may not know based on where the previous charge occurred. Always answer questions of the Court directly and honestly. It is a good idea to get advice from an attorney as to what consequences you may face in both your probation case and your new case because of the two charges.
