Description: This case involved a dispute of the continued use of a driveway over property owned by Bellsouth, after Bellsouth sold a portion of the property to my client. The rear of the building they purchased from Bellsouth was accessed for over fifty years by a driveway that went through property retained by Bellsouth. The court held that my clients could continue to use the driveway to access their property under the doctrine of an implied easement by prior use.
